WACKY WARRIORS PAINTBALL TERMS OF SERVICE

Effective Date: February 12, 2026

1. Acceptance of Terms

By accessing our website, booking services, or participating in activities at Wacky Warriors Paintball (WWP), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or participate in our activities.

2. Description of Services

Wacky Warriors Paintball provides recreational activities including:

• Paintball
• Airsoft
• Gel Blaster games
• Nerf Warz
• Equipment rental
• Private party hosting
• Group events

All services are subject to availability and proper booking procedures.

3. Age Requirements and Parental Consent

• Participants must meet minimum age requirements for each activity as posted at our facility
• Minors (under 18 years of age) must have a parent or legal guardian present to sign our liability waiver before participating
• Parents/guardians signing for minors also provide medical permission authorization for emergency treatment
• We reserve the right to verify age with photo identification
• Waivers are valid through the end of the calendar year and must be renewed annually

4. Mandatory Waiver Requirement

ALL PARTICIPANTS MUST SIGN OUR LIABILITY WAIVER BEFORE PARTICIPATING IN ANY ACTIVITIES. The waiver includes:

• Acknowledgment of inherent risks
• Assumption of risk
• Release of liability
• Medical permission (for minors)
• Photo/video consent
• Email communication consent

By participating, you acknowledge that you have read, understood, and signed the waiver. Refusal to sign the waiver will result in inability to participate, with no refund issued.

5. Booking and Reservations

• Reservations can be made online through our website, by phone at (314) 518-4436, or in person at 700 Wacky Rd, Wentzville, MO 63385
• Walk-ins are welcome subject to availability
• Group bookings (10+ people) require advance notice
• A deposit may be required to secure group reservations
• Full payment is due upon arrival unless other arrangements have been made
• Reservation times are approximate and may vary based on group size and field conditions

6. Cancellation and Refund Policy

• Cancellations made 2+ days before scheduled date: Full refund or free rescheduling
• Cancellations made less than 2 days before scheduled date: No refund; may reschedule with fee
• No-shows: No refund and no rescheduling
• Weather cancellations by WWP: Full refund or free rescheduling option
• Weather cancellations by customer: Standard cancellation policy applies
• Refunds will be processed within 7-10 business days to the original payment method

7. Payment Terms

• We accept cash, credit cards, and debit cards
• Prices are subject to change without notice
• All prices include applicable taxes unless otherwise stated
• Group rates and packages are subject to minimum participant requirements
• Returned checks will incur a service fee

8. Safety Rules and Requirements

All participants must:

• Attend and complete our mandatory safety briefing before play
• Wear approved protective face masks/goggles at all times in designated playing areas
• Keep masks on until instructed by staff that it is safe to remove them
• Follow all instructions given by WWP staff and referees
• Use markers (guns) safely and responsibly
• Never remove barrel covers/plugs in non-playing areas
• Never shoot at participants who have removed their masks or called themselves out
• Not shoot at wildlife, structures, or spectators
• Report any equipment malfunctions immediately to staff

Failure to follow safety rules will result in immediate removal from play without refund and may result in ban from future visits.

9. Assumption of Risk and Liability

As stated in our mandatory waiver, participants acknowledge that:

• Risks and dangers exist in paintball, airsoft, gel blaster, and Nerf activities
• Participation may result in injury or illness including bodily injury, disease, strains, fractures, paralysis, eye injury, blindness, heat stroke, heart attack, death, or other serious ailments
• Risks may be caused by negligence of WWP, other participants, accidents, forces of nature, or other causes
• Participants assume all risks and responsibility for losses/damages

All participants (or their parent/guardian) must sign our liability waiver acknowledging these risks before participating.

10. Equipment and Property

Rental Equipment:

• All rental equipment remains the property of WWP
• Equipment must be returned in the same condition as received (normal wear and tear excepted)
• Participants are financially responsible for lost, stolen, or damaged rental equipment
• Equipment must be inspected by staff upon return

Personal Equipment:

• Personal equipment may be used with prior approval and safety inspection by staff
• We reserve the right to prohibit any equipment deemed unsafe
• Only field-provided ammunition (paintballs, BBs, gel balls, Nerf darts) may be used
• FIELD AMMO ONLY POLICY: Outside ammunition is strictly prohibited

11. Code of Conduct

Participants and spectators must:

• Treat all staff, referees, other participants, and guests with respect
• Use appropriate language
• Refrain from violence, fighting, threatening behavior, or harassment
• Not be under the influence of alcohol or drugs
• Follow all posted rules and facility policies
• Respect facility property and equipment

Prohibited:

• Physical altercations or violence
• Harassment, bullying, or discriminatory behavior
• Alcohol, illegal drugs, or weapons on property
• Intentionally harming other participants
• Vandalism or destruction of property
• Smoking in non-designated areas

WWP reserves the right to remove anyone who violates our code of conduct without refund and may ban individuals from future visits.

12. Health and Medical Considerations

• Activities are physically demanding; participants should be in reasonable physical condition
• Participants with pre-existing medical conditions should consult their physician before playing
• Pregnant individuals are not permitted to play
• Participants must disclose any medical conditions that may affect safe participation
• Basic first aid is available on-site
• WWP is not responsible for medical expenses resulting from injuries
• In case of serious injury, emergency services will be contacted
• For minors, parent/guardian provides medical permission authorization via signed waiver

13. Weather Policy

• Games may be delayed or postponed due to severe weather (lightning, heavy storms, extreme conditions)
• Light rain does not typically cancel games unless field conditions become unsafe
• If WWP cancels due to weather, participants receive full refund or free rescheduling
• If participants choose not to play due to weather, standard cancellation policy applies
• WWP makes all weather-related safety decisions at sole discretion

14. Lost and Found

• WWP is not responsible for lost, stolen, or damaged personal property
• Lost items may be turned in to our office; held for 30 days
• Unclaimed items after 30 days will be donated or disposed of
• Leave valuables in your vehicle or at home

15. Photography, Video, and Media Release

By signing our waiver and participating at WWP, you consent to:

• Photography and video recording during your visit
• Use of your image/video for online purposes, social media, website, and promotional materials

This consent is included in our standard waiver. If you wish to opt out, you must notify staff in writing before participating.

16. Email and Marketing Communications

By signing our waiver, you consent to receive email promotions from WWP. You may opt out at any time by:

• Clicking “unsubscribe” in any email
• Contacting us directly at wackywarriors@gmail.com to remove your email from our list
• Updating your communication preferences

17. SMS/Text Messaging Terms

By providing your mobile phone number, you consent to receive text messages from WWP regarding:

21. Waiver Validity Period

All signed waivers are valid through the end of the calendar year in which they are signed. Participants must complete a new waiver each calendar year.

22. Modifications to Services and Terms

• WWP reserves the right to modify, suspend, or discontinue any service at any time
• We may update these Terms of Service at any time
• Material changes will be posted on our website
• Continued use after changes constitutes acceptance of modified terms

23. Indemnification

As stated in our liability waiver, participants agree to release, waive, discharge, hold harmless, defend, and indemnify WWP and its owners, agents, officers, and employees from any claims, actions, or losses for bodily injury, property damage, wrongful death, or otherwise arising from participation in activities.

24. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

25. Entire Agreement

These Terms of Service, along with our Privacy Policy and signed liability waiver, constitute the entire agreement between you and WWP.

26. Governing Law

These Terms shall be governed by the laws of the State of Missouri, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of St. Charles County, Missouri.
